Terms and Conditions
The following Terms and Conditions apply to all products and services provided by Reverie Press, LLC (hereinafter referred to as Reverie Press). This contract is a legal document under exclusive jurisdiction of courts within the United States of America.
All work is carried out by Reverie Press on the understanding that the client has agreed to these Terms and Conditions. These Terms and Conditions can be read at any time on the Reverie Press website.
These Terms and Conditions supersede any previous Terms and Conditions distributed in any form. Reverie Press reserves the right to change any rates and any of the Terms and Conditions at any time and without prior notice.
If any provision of this agreement shall be unlawful, void, invalid, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions and the remaining parts of it remain in place.
1. Project Acceptance
At the time of the design request, Reverie Press will provide the client with a written estimate by email.
By submitting an initial deposit, the client indicates acceptance of the estimate and of the Terms and Conditions and affirms that they have read and understood them fully.
For the avoidance of doubt, the Reverie Press Terms and Conditions are what govern all projects, not any conditions on the client’s design request form(s) nor any other conditions provided by the client unless expressly agreed upon by both parties in writing.
2. Service Charges
Charges for services to be provided by Reverie Press will be set out in the written estimate that is provided to the client.
Unless otherwise agreed in writing by both parties, all services require a non-refundable deposit payment of a minimum of fifty (50) percent of the project estimate total before any work commences or is supplied to the client for review.
The remaining balance of the estimated total will be due upon completion of the work. This balance must be paid prior to the release of finalized files.
Estimates are provided based on the client’s design request form and/or the written brief between the client and Reverie Press. Changes to the design request form or brief may result in additional fees. In such cases where the client incurs additional fees, the client will be notified prior to the continuation of work.
The client must assume that all additions, alterations, changes in content, layout or process changes requested by the client after the acceptance of the original estimate and subsequent submission of the initial deposit are subject to additional fees.
2C. Charges for Other Services
Any additional services requested during the project that are over and above the original estimate and/or out of scope of the initial project may be subject to a new and separate quote. Reverie Press will make the distinction based on project scope and judge whether said charges shall be added to the balance of the current estimate or shall require a new and separate quote.
When Reverie Press requires a new and separate quote, said quote shall be subject to the same payment terms as the original estimate – that is, a minimum of fifty (50) percent of the newly-quoted amount is due at the time of the new estimate acceptance. The remaining balance of the newly-estimated total will be due upon completion of the work prior to the release of finalized files.
In some cases, the client may request that Reverie Press purchase elements particularly for the client’s project, including but not limited to specific photography, fonts, or additional design elements. The client shall advance, in full and up front, the full cost of any elements the client requests Reverie Press purchase to complete the client’s project. The client understands and agrees that both parties shall maintain the Terms and Conditions related to any said purchases.
3A. Initial Payment
A non-refundable fifty (50) percent deposit will be invoiced at the time of booking. This initial fifty (50) percent deposit is due prior to the commencement of any work. To be clear: Reverie Press shall not begin work on the client’s project until the initial deposit payment has cleared.
Payment is by PayPal only at this time. PayPal also permits customers to make purchases without having a PayPal account. The client can submit payment through PayPal using a debit/credit card and is not required to sign in.
Should the client submit payment using a PayPal eCheck, Reverie Press shall not commence work until it has received notification from PayPal that the eCheck has cleared. Bear in mind: this can be up to 10 working days, and sometimes longer. Payments made by PayPal eCheck must be previously agreed upon by both the client and Reverie Press in writing by email.
3B. Final Payment
Final payment is due within seven (7) days of the final invoice being sent. The client will be provided with an approval form or proof email and an invoice prior to the release of finalized files. At that time, the client will be required to signify final approval in writing by email to Reverie Press and the remainder of the amount due will become payable. The remaining balance is not due until completion of the project.
No finalized files will be sent, nor any materials released, until payment is made in full.
Any invoice inquiries must be submitted in writing by email within five (5) days of the invoice date.
A 5% late fee will be added for each week that payment is not made. If an invoice goes unpaid for more than ninety (90) days following the invoice date, an additional $100 fee will be applied.
Balance invoices are due within seven (7) days of the final invoice being sent.
The grant of any license or right of copyright is conditioned on receipt of full payment. Publication and/or release of work done by Reverie Press on behalf of the client may not take place before cleared funds have been received.
The client shall assume responsibility for cost outlays by Reverie Press in all collections of unpaid fees and of legal fees necessitated by default in payment. Invoices in default will include but are not limited to fees for collection and legal costs. Customers whose accounts become default agree to pay all Reverie Press’s reasonable legal and accounting expenses and third party collection agency fees in the enforcement of the debt and these Terms and Conditions.
If a final invoice for design services remains unpaid for thirty (30) days from the date of invoice, Reverie Press shall be entitled to place, or return, the design to the Reverie Press purchasable inventory or to the Reverie Press portfolio; however, said action does not relieve the client of their obligation to pay the amount due.
3D. Rush Order Requests
Reverie Press can occasionally handle rush orders. A rush project with less than a week turnaround will require a $500.00 added fee. A rush project with a two week or longer turnaround will require a $300.00 added fee. Rush order fees must be paid in advance, prior to commencement of any work on the rush order.
3E. Revision Process
This contract includes the purchased design plus the opportunity for the client to make revisions as offered on the Terms of Service Agreement for Premade Cover Art and Designs page of the Reverie Press website.
If the client is not happy with the design after the second included proof, the client may be able to commission Reverie Press to make further design revisions at an additional rate, including individual charges for each additional proof required.
If the client is not happy with the design after the second included proof, the client may instead choose to cancel the contract, but no refunds will be given for services rendered up to that time.
3F. Project Completion
When the client provides final approval, they shall be expected to provide final payment as laid out in the payment terms above, and finalized files will be released upon receipt of final payment, thereby signaling completion of the project.
Other services, including, but not limited to, author coaching and KDP assistance may constitute a separate project and may be treated as a separate charge.
3G. International Customers
Reverie Press welcomes clients from all over the world and is happy to discuss your project requirements. Payment can be made via PayPal, who will convert your currency to USD automatically.
3H. Refund Policy
Due to the nature of Reverie Press’s products and services, once the client has received the finalized files and any watermarks have been removed, absolutely no refunds and/or exchanges will be given. Should Reverie Press’s images (or partial designs) be used online when full payment for those designs has not been received (or a refund has been processed), this may give rise to a claim for damages and/or be a criminal offense.
Reverie Press does not provide refunds for any non-design services it provides. This includes deposits and scheduling fees. All services sales are final.
4. Design Services
Prices are subject to change at any time, and without warning. Price is only guaranteed upon receipt of the client’s initial deposit.
4A. Expectations of The Working Relationship
By submitting the initial deposit, the client indicates that they have the power and ability to enter into this contract on behalf of themselves, their company, or their organization.
The client agrees to provide Reverie Press with everything it needs to complete the client’s project, including text, images, and other information as and when Reverie Press needs it, and in the format that Reverie Press requests.
The client agrees that during the workflow, they will review any proofs Reverie Press renders and will provide feedback and sign-off approval (in writing via email) in a timely manner.
Reverie Press will carry out all requested services in a professional and timely manner. Reverie Press will endeavor to meet all deadlines set, but Reverie Press cannot and will not be responsible for any missed book launches or deadlines if the client has been late in providing materials and/or has not signed off on proofs on-time at any stage. It is the client’s responsibility to report any and all relevant details for their project before purchase. Any changes to this information can result in additional fees and may cause a cancellation of the client’s order, without refund, at Reverie Press’s discretion. Reverie Press will maintain the confidentiality of any information the client provides.
4B. Proof(s) Expiration
Premade covers: All required information for the first proof of a premade cover must be received by Reverie Press within one (1) year of the original purchase. If the client exceeds this timeframe, additional fees will apply. Twenty-four (24) months after the original purchase date, if the files have not been finalized, the order will be canceled without refund, and Reverie Press no longer has any obligation to fulfill the order or hold the files unless otherwise specified.
In the case of premade cover orders for a book series, all required information for the first cover must be received by Reverie Press within one (1) year of the original purchase. Each additional cover included in the premade cover series purchase extends the timeframe by one (1) year. (In other words, the first cover’s information must be submitted within one (1) year, the second cover’s information within two (2) years, and so on.) If these criteria are not met, the order will be canceled without refund, and Reverie Press no longer has any obligation to fulfill the order or hold the files.
Custom covers: All required information for the first proof of a custom cover must be received by Reverie Press as directed in the initial brief or within ninety (90) days of the original purchase. If this timeframe is exceeded, additional fees may apply.
Add-on & other designs (book teaser images, etc.): All required information for the first proof of an add-on or other design must be received by Reverie Press as directed in the initial brief or within ninety (90) days of the original purchase. If this timeframe is exceeded, additional fees may apply.
4C. Proof Workflow
Two proofs are included, free-of-charge, with each cover and/or each design purchase. The client will have the opportunity to review each proof and request any additional revisions needed. Terms of Service Agreement for Premade Cover Art and Designs page of the Reverie Press website for a more detailed description of available changes and their potential associated fees.
4D. Final Approval
All proof approvals should be submitted in writing via email and are absolutely final. The client may request changes after final approval is given if necessary, but additional fees will apply, and any deadline for delivery of finalized files is no longer guaranteed.
4E. Usage Of Title, Author Names, And Tag Lines/Quotes/Reviews On Reverie Press Designs
All titles, author names, and any tag lines, quotes, or reviews used on Reverie Press’s purchasable inventory of covers and designs are fictitious and for illustration purposes only. They have no connection to any person living or dead or to any prior publications. Any similarity in any of the titles, author names, quotations, tag lines, or book reviews shown is purely coincidental and used simply to illustrate the design. All Reverie Press placeholder text, quotes, taglines, etc. will be replaced by specific cover information as requested and based on individual clients’ instructions.
4F. Copyrights, Trademarks, and Licensing
By supplying text, images, and other data to Reverie Press for inclusion in the client’s project, the client declares that it holds the appropriate copyright and/or trademark permissions. The ownership of such materials will remain with the client or rightful copyright or trademark owner.
Any artwork, images, or text supplied and/or designed by Reverie Press on behalf of the client, will remain the property of Reverie Press and/or its suppliers unless otherwise agreed in writing. A license for the use of the copyrighted material is granted to the customer solely for the project defined in the scope or request and not for any other purpose.
By supplying images, text, or any other data to Reverie Press, the client grants Reverie Press permission to use this material freely in the pursuit of the design.
The client may request in writing from Reverie Press the necessary permission to use materials (for which Reverie Press holds the copyright) in forms other than for which it was originally supplied, and Reverie Press may, at its discretion, grant this and may charge for the additional usage. Such permission must be obtained in writing before any of the aforesaid artwork, images, text, or other data is used.
Should Reverie Press, or the client supply an image, text, audio clip or any other file for use in a digital or print item, multimedia presentation, advertisement, or any other medium believing it to be copyright and royalty-free, which subsequently emerges to have such copyright or royalty usage limitations, the client will agree to allow Reverie Press to remove and/or replace the file.
The client agrees to fully indemnify and hold Reverie free from harm in any and all claims resulting from the customer in not having obtained all the required copyright, and/or any other necessary permissions.
Copyright is retained by Reverie Press on all design work including words, pictures, ideas, visuals, and illustrations unless superseded by previous license, permissions or copyright, or specifically released in writing and after all costs have been settled.
4G. Image Usage
Images used on this website are covered by licensing terms as dictated by their original source libraries. Reverie Press does not make available the original images, and these cannot be reproduced directly from the Reverie Press website, as per the terms of the licensing agreement.
Cover and proofs may display an embedded watermark image to deter copyright theft. Removal (or partial removal) of this watermark by any party other than Reverie Press is strictly prohibited.
Reverie Press has either purchased the rights to use (or owns outright) the images shown on all Reverie Press’s covers and designs.
Each of Reverie Press’s covers is licensed for use on a single publication.
By purchasing a cover from Reverie Press, the client agrees that only one version of the cover will be uploaded once complete. Any reproductions of a cover purchased from Reverie Press using the same design for further novels in a series is strictly prohibited.
Client-provided images: The client may choose to provide images. If the client chooses to provide images, the client must obtain the correct rights, licenses, and/or permissions for the use of the image(s) they are providing.
When the client chooses to provide their own images for a design, those images must be licensed for commercial use. The client agrees to notify Reverie Press which libraries or sources the image(s) have been procured from. The client agrees to indemnify and hold harmless Reverie Press from any and all copyright and permission infringement action resulting from materials the client provides. The responsibility to ensure the materials can be used on book covers or other designs lies with the client and not with Reverie Press. By using Reverie Press’s design services, the client agrees that all licensing and permissions have already been granted on images the client provides Reverie Press to work with. No responsibility is held by Reverie Press on images provided by the client that may be incorrectly licensed. This does not apply to designs where Reverie Press has purchased the images. The details provided in this section apply to designs using images provided by the customer.
Reverie Press-provided images: In most cases, Reverie Press will provide and/or produce the images used in design services. While these images will not be re-used in custom or premade covers, Reverie Press may maintain sources including similar images. Variations in the angle or other different variations of the image may still be available. Which images get used is up to Reverie Press’s discretion.
Reverie Press assumes responsibility for images used on Reverie Press premade ebook covers, print covers, and audiobook cover designs as well as custom book cover designs where Reverie Press has purchased the images.
Reverie Press cover designs and other designs may not be sold, reused, or used out of context aside from the specified book-related digital usage, printing, reproductions, and otherwise. Reverie Press cover designs and other designs may be used for any print promotion and online promotional use. Reverie Press cover designs and other designs may not be used for sale items other than the ebook and print book. Completed designs may not be used on any other printed work by alternate designers. No completed image shall be, under any circumstances, altered without prior permission by Reverie Press.
Reverie Press covers and other designs completed by Reverie Press, including, but not limited to, teaser images and book cover reveal images cannot be sold without the title & author information (i.e. “only the picture”). This is a violation of stock licensing. Similarly, the client is required to request any and all necessary revisions to the art before giving final approval. Any changes made to the approved final files violates the license applicable to Reverie Press’s covers and designs.
4H. Stock Photography
The client agrees to abide by the licensing terms for all stock images used in their design. If the custom, premade, or other design the client has purchased includes stock photography, the client is responsible for maintaining the Terms and Conditions related to that stock, as laid out by the individual stock image provider.
All images are bought on a standard license unless otherwise agreed, and the client will be notified of which libraries images have been sourced from. The client agrees to cover all expenses incurred should they not adhere to the licensing agreement of images used.
A copy of the necessary licensing agreement(s) will be provided by Reverie Press upon request.
A standard license does limit the number of saleable units (for a print-run) or number of sales (for an ebook), though the limit varies between libraries and image sources. For unlimited usage, there is an additional fee. Should the client wish to purchase unlimited usage rights at the time of ordering, or at any point in the future, please let Reverie Press know.
4I. Source Files
Reverie Press will supply merged proofs, JPGs, and PDFs as appropriate for printing, digital media, or other graphic files as detailed in the job scope or request.
Charges for design work do not cover the release of Reverie Press’s copyright design source files. Original artwork files are not included as part of the final product of any design work performed by Reverie Press. However, if the client absolutely must have access to an editable file for themselves or for transfer to another designer, the client must inform Reverie Press immediately and state their intended use of the file. Reverie Press does not promise to deliver editable files for any reason, but if Reverie Press agrees that editable files will be provided, additional fees will apply, subject to a separate estimate or ‘buy-out’ charge. In some cases, this may not be possible without the client purchasing their own commercial licenses to any images, fonts, stock elements, etc. used in the design.
Reverie Press provides only completed designs and not book cover or other stock art.
4J. Image Standards
The following list is not all-inclusive, but these are the standards for commonly produced items at Reverie Press: digital & web items are web-quality JPGs of 72dpi. Print & press items are print-ready quality JPGs or PDFs (whichever file type is more appropriate for the specific use-case) of 300dpi. Any deviation from these must be discussed with Reverie Press in advance and may require an additional fee.
Any design, copywriting, drawing, idea or code created for the client by Reverie Press is licensed for use by the client on a one-time-only basis and may not be modified, re-used, or re-distributed in any way or form without the express written consent of Reverie Press.
All design work where there is a risk that another party makes a claim should be registered by the client with the appropriate authorities prior to publishing or first use or searches and legal advice sought as to its use.
Reverie Press will not be held responsible for any and all damages resulting from such claims.
Reverie Press is not responsible for any loss, or consequential loss, non-delivery of products or services, of whatever cause. The client agrees not to hold Reverie Press responsible for any such loss or damage.
Any claim against Reverie Press shall be limited to the relevant fee(s) paid by the customer.
Ownership of Artwork, Copyrights, Trademarks, Licensing: Reverie Press maintains full rights of all original artwork. Artwork and concept, including layout, image style, placement, and fonts may not be recreated by another person (client or alternate artist included).
The client guarantees to Reverie Press that any elements of text, graphics, photos, designs, trademarks, or other artwork that the client provides to Reverie Press for inclusion in the design are either owned by the client, or that the client has permission to use them. The client maintains the rights to any stock photos that they have downloaded.
The client retains ownership of text content, photographs, and other data the client provides, unless someone else owns them. The Terms and Conditions of the stock photography purchased for inclusion in the final design are assigned to the client and applicable to the client’s use of the finalized files. It is the client’s responsibility to ensure proper attribution is given where necessary for any resources included in the finalized files.
The client understands that any cover or design may not be altered by anyone except Reverie Press in whole or in part. The client also understands that additional charges may apply for any alterations after approval and/or after finalized files are sent.
After the artwork has been approved and the finalized files are released to the client, copyright is assigned as follows: The client is licensed to use the graphics and other visual elements for the purpose(s) for which they were created. This is a personal and royalty-free license to use the work produced by Reverie Press in the designated manner. The client may resize the cover for promotional and/or marketing needs as long as the full-sized file is not stretched beyond 50% of the original dimensions. Any changes to the art or sub-licensing to others must be pre-approved by Reverie Press and may require additional cost.
For premade and custom book covers: The customer is issued an exclusive license to use the final cover design for his/her book and/or ebook cover and associated promotional materials.
For add-on designs or other designs that are not book covers: The customer is issued an exclusive license to use the final files for the stated purpose only.
4L. Storage of Final Files
Reverie Press will provide a copy of the finalized files, and the client should store them safely as Reverie Press is not required to keep them. Reverie Press will not provide any native source files that were used in making the finalized files, unless otherwise agreed upon as directed above. Finalized files consist only of ready-to-use artwork.
4M. Unused Drafts Policy
Reverie Press produces several different concepts for Reverie Press’s custom cover designs. Once the client has chosen the particular design concept they wish to use for their cover, Reverie Press reserves the right to upload any remaining cover concepts to the premade section of the Reverie Press website (only when they in no way resemble the custom cover the client has purchased).
If a choice of designs is presented and one is chosen by the client, only that product is deemed to be given by Reverie Press as fulfilling the job. All other designs remain the property of Reverie Press unless agreed explicitly by both parties in writing.
The client agrees that changes required over and above the estimated work, or in addition to the agreed scope, or where the client makes changes to the supplied copy or changes required to be carried out after acceptance of the final design, will be liable to a separate charge.
The client also agrees that Reverie Press holds no responsibility for any amendments made by any third party, before or after a design is published.
4O. Data Formats
The client agrees to Reverie Press’s definition of acceptable means of supplying data. Text is to be supplied to Reverie Press in electronic format as standard text (.txt), MS Word (.docx), Pages (.pages) or via email or shared online folder (Google Drive, Dropbox, etc.).
Images which are supplied in an electronic format are to be provided in a format as prescribed by Reverie Press via email. Images must be of a quality suitable for use without any subsequent image processing, and Reverie Press will not be held responsible for any image quality which the client later deems to be unacceptable.
Reverie Press cannot be held responsible for the quality of any images which the client wishes to be scanned from printed materials.
Additional expenses may be incurred for any necessary action, including, but not limited to, photography and art direction, photography searches, media conversion, digital image processing, data entry services, color correction, and alteration of images.
Premade designs created by Reverie Press are sold exclusively to one customer. Premade covers are never re-sold. However, Reverie Press does often rely on stock photography, so there is a chance that another author or designer will use the same image, and thus Reverie Press cannot be held liable in such a circumstance.
4Q. Restrictions & Rights of Refusal
Reverie Press will not produce book covers that portray images of sexual violence or animal cruelty.
Reverie Press will not include in its designs any text, images, or other data which it deems to be immoral, offensive, obscene, or illegal. All advertising material must conform to all standards laid down by all relevant advertising standards authorities.
Reverie Press also reserves the right to refuse to include submitted material without giving reason. In the situation where any images and/or data that Reverie Press does include in all good faith, and subsequently discovers is in contravention to such Terms and Conditions, the client is obliged to allow Reverie Press to remove the infringement without hindrance or penalty. Reverie Press is to be held in no way responsible for any such data being included.
Cancellation of orders must be made in writing by email.
In the event of a cancellation before work has started, no further expenses will be owed.
If Reverie Press has begun work on the project, some or all of the remaining balance may be owed. The client may be subject to a cancellation fee for work completed and expenses already incurred. The cancellation fee is figured from a percentage based on the amount of work completed over and above the non-refundable deposit that will have been made at the time of first ordering.
A 100% cancellation fee is due once the project has been finished, whether delivered to the client or not.
Any balance owed in the event of a cancellation must be paid within seven (7) days.
Once the client has received the finalized files and any watermarks have been removed, absolutely no refunds and/or exchanges will be given.
In the event of cancellation of a project, ownership of all copyrights and the original artwork shall be retained by Reverie Press.
Premade Design Cancellations: Premades are first come, first served. Should the client change their mind or no longer wish to continue with the project for any reason, the original cover will be re-uploaded to the Reverie Press website and offered for sale again.
6. Design Attribution
Attribution to Reverie Press for the design is required.
For book covers, it can be included in the front matter and/or on the back cover of the design for the client’s ebook and/or paperback book. Ebook files have the option to be linked to the Reverie Press website, but it is not required. Please use either “Cover design by Reverie Press” or “Cover design by Reverie Press (www.reveriepress.com)”.
Reverie Press also requests a credit line with any other usage (for example, any instances where the client shares book covers or other designs online and/or via social media). Design credit should be included in the comment or caption as “Teaser design by Reverie Press” (where “teaser” is replaced by the applicable term for the type of image the client is sharing) or by tagging Reverie Press in the post.
A false attribution to anyone other than Reverie Press is strictly prohibited.
7. Feedback, Comments, and Promotional Usage
Reverie Press reserves the right to use positive feedback and comments from emails/social media in testimonials on the Reverie Press website and on Reverie Press’s social media accounts.
Reverie Press always maintains the limited rights to its designs to use as any sort of self-promotion, portfolio, client viewing, etc. The client agrees to allow Reverie Press to feature book covers and other designs it has produced, along with a link to the client’s book, Amazon page, or similar on Reverie Press’s own website and/or on social media websites for demonstration purposes and to use any designs in Reverie Press’s own publicity and portfolios. Reverie Press may also write and/or talk about the project on websites, in interviews, and in any other forums where discussion of design takes place. Should the client not wish their cover or design to be included in such promotions, the client must let Reverie Press know once their cover or design has been completed. Reverie Press will then ensure the client’s cover or design is not included in such promotions.
Reverie Press will endeavor to not feature a cover or design that has not already been made public by the client.
Reverie Press is not liable for damages of any kind, including loss of revenues, profits, business, reputation, or data, in any way related to its services. Reverie Press is not responsible for any claim, loss, or injury based on errors or inaccuracies appearing on its site or in its client’s project once the client’s project has been approved.
Liability & Releases: It is agreed that Reverie Press is not responsible or held liable for any errors contained in the final product after the final product has been approved by the client, (approval must be given in writing via email), committed to print, displayed digitally, or in any other way posted in view of the public. Reverie Press will not be held responsible for any changes or amendments made after approval. It is the sole responsibility of the client to notify Reverie Press of any such errors during the revision cycle and before the final files have been generated. Reverie Press cannot be liable to the client or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages arising out of any errors approved by the client.
Reverie Press makes no warranties of any kind, express or implied, for any and all products and/or services that it supplies. Reverie Press will not be held responsible for any and all damages resulting from products and/or services it supplies. Reverie Press is not responsible for any loss, or consequential loss of data, or non-delivery of products or services, of whatever cause. While Reverie Press takes reasonable steps to investigate the materials it recommends, it accepts no responsibility for the performance or quality of materials or any consequential loss arising from their failure. The client agrees not to hold Reverie Press responsible for any such loss or damage. Any claim against Reverie Press shall be limited to the relevant fee(s) paid by the client.
Reverie Press reserves the right to use the services of sub-contractors, agents and suppliers and any work, content, services and usage is bound by their Terms and Conditions. Reverie Press will not knowingly perform any actions to contravene these and the client also agrees to be so bound.
8B. Design Project Duration
Any indication given by Reverie Press of a design project’s duration is to be considered by the client to be an estimation. Reverie Press cannot be held responsible for any project over-runs, whatever the cause. Estimated project duration should be deemed to be from the date that cleared funds are received by Reverie Press for the initial payment or by date confirmed in writing by Reverie Press.
Should Reverie Press take longer to complete a project than originally indicated (including, but not limited to, family emergency, act of nature, etc.) the client will be contacted via email in order to agree upon a new project completion date.
8C. Rights of Access for KDP Assistance
The client agrees to allow Reverie Press all necessary access to computer systems and other locations, as required, in order to complete KDP (Kindle Direct Publishing) assistance and until all due funds are cleared, including the necessary permissions, usernames and passwords. The client also agrees to allow Reverie Press access to any computer systems, usernames and passwords required to remove data and/or sites for failure to comply with these Terms and Conditions.
The customer agrees to supply Reverie Press with all necessary materials, electronic, or otherwise, required to create and complete the project, and to supply them in a timely manner.
8D. Limitation of liability
The client agrees that it shall not hold Reverie Press liable for any incidental or consequential damages that arise from Reverie Press’s failure to perform any aspect of the project in a timely manner, regardless of whether such failure was caused intentional or negligent acts or omissions of Reverie Press or the client, any client representatives or employees, or a third party.
The client shall indemnify Reverie Press against all claims and expenses, including attorney’s fees, due to the uses for which no release was requested in writing or for uses that exceed authority granted by a release.
8F. Fair Practice
Reverie Press acknowledges that to the best of its knowledge, the work prepared is an original creation and has not been previously published and/or consent to use has been obtained. The work prepared does not contain any scandalous, libelous, or unlawful matter. The client and/or others may not use Reverie Press’s product in any way that may infringe upon the rights of others.
9. Acceptance of Terms
Acceptance of Terms & Conditions and Quotation
The action of receipt of this agreement and subsequent commission of work will hold both Reverie Press and the client in acceptance of these Terms and Conditions. By acceptance of these Terms and Conditions, the client agrees to hold Reverie Press entirely free from any liability, including financial.
The placement of an order for design and/or any other services offered by Reverie Press is deemed to be acceptance of these Terms and Conditions, which are freely available on the Reverie Press website.
Likewise, the placement of an order for design and/or any other services offered by Reverie Press is deemed to be acknowledgment and agreement by the client to comply fully with all the Terms and Conditions and forms a contract for business between the client and Reverie Press.
Failing to abide by the Reverie Press Terms and Conditions can result in a cancellation of the client’s project, without refund, at Reverie Press’s discretion.
The client cannot transfer this contract to anyone else without Reverie Press’s permission. This contract stays in place and need not be renewed. If, for some reason, any provision of this agreement shall be unlawful, void, invalid, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. The remaining parts of it remain in place.
